«الرقابة المالية» توضح موقفها من «حوالة الحق» في عقود المطورين العقاريين

أصدرت الهيئة العامة للرقابة المالية توضيحًا بشأن ما تم تداوله من معالجات إعلامية وصفتها بغير الدقيقة لبيانها السابق حول «حوالة الحق» في العقود الخاصة بالمطورين العقاريين. وأكدت الهيئة أنها لم تصدر أي قرارات أو تعليمات جديدة بشأن «حوالة الحق»، كما أنها لم تحظر تضمين العقود بندًا يسمح بإجراء حوالة الحق. وأوضحت أن القانون المدني يجيز لأطراف العقد إجراء «حوالة الحق»، وينظم أحكامها وفقًا لما ورد في الفصل الأول من الباب الرابع من القانون. وشددت الهيئة على أن البيان يأتي في إطار توضيح موقفها القانوني وتصحيح أي فهم غير دقيق لما ورد في بيانها السابق. وأكدت مجددًا عدم صدور أي إجراءات أو قرارات جديدة تحظر أو تقيد إدراج بند «حوالة الحق» في عقود المطورين العقاريين.
